Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Incremenza platform provided by Incremenza LLC ("Incremenza," "we," "us," or "our"). This policy is part of our Terms of Service and applies to all users of the Service.

1. Purpose

This AUP is designed to:

  • Protect Incremenza, its users, and the broader internet community from harmful activities
  • Ensure the Service remains secure, reliable, and available for all legitimate users
  • Comply with applicable laws and regulations
  • Maintain the integrity and reputation of the Incremenza platform

2. Prohibited Activities

You agree NOT to use the Service for any of the following prohibited activities:

2.1 Illegal Activities

  • Violating any local, state, national, or international law or regulation
  • Engaging in, promoting, or facilitating illegal activities (fraud, money laundering, tax evasion, etc.)
  • Processing payments for illegal goods, services, or activities
  • Infringing on intellectual property rights (copyright, trademark, patents, trade secrets)
  • Violating privacy laws or regulations (GDPR, CCPA, etc.)

2.2 Fraudulent or Deceptive Practices

  • Providing false, inaccurate, or misleading information when creating an account
  • Impersonating another person, company, or entity
  • Creating multiple accounts to circumvent service limits or enforcement actions
  • Engaging in phishing, identity theft, or other fraudulent schemes
  • Processing fraudulent transactions or chargebacks through embedded payments
  • Manipulating financial data to deceive lenders, investors, or tax authorities

2.3 Harmful or Abusive Content

  • Uploading or transmitting viruses, malware, ransomware, or other malicious code
  • Distributing spam, unsolicited commercial messages, or bulk emails
  • Harassing, threatening, or abusing other users or Incremenza staff
  • Posting content that is defamatory, obscene, hateful, or discriminatory
  • Sharing content that promotes violence, terrorism, or self-harm
  • Distributing child exploitation material (illegal and results in immediate account termination and law enforcement notification)

2.4 Security and System Abuse

  • Attempting to gain unauthorized access to the Service, other users' accounts, or Incremenza's systems
  • Bypassing, disabling, or interfering with security features or access controls
  • Conducting penetration testing, vulnerability scanning, or security research without prior written authorization
  • Launching denial-of-service (DoS) attacks or other attempts to disrupt the Service
  • Using automated tools (bots, scrapers, crawlers) to access the Service without permission
  • Reverse engineering, decompiling, or attempting to extract source code
  • Exploiting bugs, vulnerabilities, or unintended features for unauthorized purposes

2.5 Misuse of Service Features

  • Using the Service to compete with Incremenza or build a similar product
  • Reselling, leasing, or redistributing access to the Service without authorization
  • Using the Service on behalf of third parties without proper authorization (e.g., providing it as a service bureau)
  • Excessive use that degrades performance for other users (e.g., uploading millions of transactions to test system limits)
  • Sharing account credentials with unauthorized users
  • Using the Service to store or transmit data unrelated to legitimate business operations

2.6 Payment Processing Violations

If you use Incremenza's embedded payment features, you also agree NOT to:

  • Process payments for prohibited businesses or activities as defined by Stripe's terms
  • Engage in credit card fraud, identity theft, or unauthorized charges
  • Process excessive chargebacks or disputed transactions
  • Withhold refunds from customers or engage in unfair billing practices
  • Use stolen credit cards or bank account information
  • Engage in structuring transactions to avoid detection or reporting requirements

2.7 Data Privacy Violations

  • Uploading data you do not have the legal right to share (e.g., data stolen from another company)
  • Sharing other users' personal information without their consent
  • Using the Service to collect, store, or process personal data in violation of privacy laws
  • Accessing or attempting to access another company's data

3. Acceptable Use Guidelines

To use the Service responsibly:

3.1 Account Security

  • Use strong, unique passwords for your account
  • Enable two-factor authentication when available
  • Do not share login credentials
  • Notify us immediately of any suspected unauthorized access
  • Deactivate accounts for users who leave your organization

3.2 Data Accuracy

  • Provide accurate and truthful information when creating your account
  • Ensure uploaded financial data is accurate and belongs to your business
  • Review and verify AI-generated transaction categorizations
  • Keep your company profile and settings up to date

3.3 Respectful Communication

  • Be professional and courteous when contacting support
  • Provide clear, detailed information when reporting issues
  • Respect the time and expertise of Incremenza staff

3.4 Fair Usage

  • Use the Service only for your legitimate business operations
  • Avoid excessive API calls or actions that could degrade service performance
  • Follow subscription limits (users, transactions, integrations) for your plan
  • Upgrade to a higher plan if you exceed usage limits

4. Enforcement

4.1 Violation Detection

Incremenza monitors for AUP violations through:

  • Automated systems that detect unusual activity patterns
  • User reports and complaints
  • Third-party notifications (payment processors, integrations, law enforcement)
  • Periodic manual reviews of flagged accounts

4.2 Actions We May Take

If we determine you have violated this AUP, we may take one or more of the following actions:

  • Warning: Email notification requesting you cease the prohibited activity
  • Feature Restriction: Temporary or permanent restriction of specific features (e.g., embedded payments)
  • Account Suspension: Temporary suspension (read-only access) while we investigate
  • Account Termination: Immediate and permanent account closure for serious violations
  • Legal Action: Civil or criminal legal proceedings for illegal activities
  • Law Enforcement Notification: Reporting violations to appropriate authorities

4.3 Immediate Termination Offenses

The following violations result in immediate account termination without warning:

  • Child exploitation material (also reported to law enforcement)
  • Terrorism or violent extremism
  • Ransomware or other malware distribution
  • Large-scale fraud or financial crime
  • Severe security breaches (hacking, data theft)

4.4 Appeals Process

If your account is suspended or terminated:

  • You will receive an email explaining the reason for the action
  • You may appeal by contacting [email protected] within 14 days
  • Provide a detailed explanation and evidence supporting your appeal
  • We will review appeals within 7 business days and respond via email
  • Our decision on appeals is final

Note: Immediate termination offenses (see above) are not eligible for appeal.

5. Reporting Violations

5.1 How to Report

If you become aware of AUP violations:

  • Include account information, screenshots, or other evidence if available
  • We will investigate all reports promptly

5.2 Confidentiality

  • Reports are treated confidentially
  • We do not disclose the identity of reporters unless required by law
  • False or malicious reports may result in action against the reporter

6. Cooperation with Law Enforcement

  • Incremenza cooperates with law enforcement agencies investigating illegal activities
  • We may disclose account information and usage data when legally required (subpoena, court order, warrant)
  • We proactively report certain serious violations (child exploitation, terrorism) to authorities
  • We maintain logs and records to assist investigations when appropriate

7. No Liability for User Actions

  • Incremenza is not responsible for user-generated content or activities
  • You are solely responsible for your use of the Service and compliance with this AUP
  • You agree to indemnify Incremenza against claims arising from your AUP violations
  • Incremenza does not pre-screen or approve content, but reserves the right to remove violating content

8. Changes to This Policy

  • We may update this AUP to address new threats, legal requirements, or service changes
  • Material changes will be notified via email at least 30 days in advance
  • Updated "Last Updated" date will be posted at the top of this page
  • Continued use after changes constitutes acceptance
